Thank you for your interest in the California Cultural Data Project (“California CDP”) Web site (“Site”) developed and hosted by The Pew Charitable Trusts (“we,” “our,” or “PCT”) on behalf of The Greater Philadelphia Cultural Alliance, The Heinz Endowments, The Pennsylvania Council on the Arts, The Pew Charitable Trusts, The Pittsburgh Foundation, The Greater Pittsburgh Arts Council and The William Penn Foundation (collectively, the “PACDP Governing Group”), and made available to you by the California Arts Council, Los Angeles County Arts Commission, The Getty Foundation, The James Irvine Foundation, The William and Flora Hewlett Foundation, and other cultural organizations participating in the California CDP(collectively, the “California CDP Partners”). Please read the following terms and conditions (the “Terms of Use”) as they govern your use of the Site. Please note that by using the Site, you are agreeing to the Terms of Use. The Terms of Use may be updated from time to time, so we encourage you to check back regularly for the most current version.
1. Grant of License. These Terms of Use provide you with a non-exclusive, royalty-free license to use the Site. You may print and download materials and information from the Site solely for your personal and/or your organization’s non-commercial use, provided that you do not obscure, alter, remove or delete any copyright or other proprietary rights notices contained in such materials and information. You may not reverse engineer, decompile, deconstruct, or frame any portion of the Site without PCT’s prior written permission. You may link to the home page of the Site (www.caculturaldata.org), provided that you do not use any logo or design owned by the PACDP Governing Group and that you refer to the Site as the “California Cultural Data Project” in plain text format.
2. Intellectual Property Rights. All information and material contained in and offered through the Site is protected by law, including, but not limited to, United States copyright and trademark laws. The Site, its content, including its layout, design and underlying software, are the exclusive property of the PACDP Governing Group, unless otherwise indicated. The Site and its contents are “© 2004 - 2007 The Pennsylvania Cultural Data Project Governing Group. All rights reserved.” In addition, the “CULTURAL DATA PROJECT” and “CDP” marks, and any variations thereof, as well as all other trade/service marks, trade names, logos, and icons displayed in the Site, unless otherwise indicated, are proprietary to the PACDP Governing Group.
3. Links to Other Web Sites. The Site may include links to third-party Internet web sites including information relevant to you, your organizations and/or the California CDP and related projects. These other web sites have not necessarily been reviewed by us and are maintained by third parties over whom we do not exercise any control. Accordingly, neither we, nor any PACDP Governing Group member or California CDP Partner, shall be responsible for the content, the accuracy of the information, or the quality of products or services provided by these third-party web sites. Moreover, these links do not imply an endorsement by us, or any PACDP Governing Group or California CDP Partner, of any third party or any web site, product or service provided by any third party.
4. Privacy Policy. When you register to use the software and services offered through the Site, you will be asked for information about your organization, such as your organization’s name, address, telephone number and the business contact information for a representative of your organization. Some of the information you provide may be the personal identifying information of any authorized representative of your organization (such as a personal e-mail address or home telephone number). PCT will only use the personal identifying information you provide in order to perform the services for which you have registered. In addition, the PACDP Governing Group members, the California CDP Partners, and other grant providers participating in the California CDP project will be able to access to and use the personal identifying information you provide for the purpose of evaluating and processing your grant application(s) and for other decision-making, analysis and research purposes. Please note that the California CDP Partners may be required to disclose information you provide under the California Public Records Act (California Government Code section 6250, et seq.) and/or under other applicable laws. Any personal identifying information will not be shared, sold, or otherwise transferred to any other third party (unless required by law), although we may transfer your information to any entity as part of a reorganization of PCT or a PACDP Governing Group member or California CDP Partner. 5. Governing Law. Except with respect to the specific references to California laws, these Terms and Conditions will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts of law provisions, and you hereby consent to the exclusive jurisdiction of the state and federal courts sitting in Philadelphia, Pennsylvania.
